MiuTaxi 秒的 · 乘客使用條款

1.1「的士租收」／「平台」指由的士租收管理有限公司（「的士租收」）營運的流動應用程式及網上平台，供乘客預約的士服務及的士司機提供服務。"Miutaxi" / "Platform" means the mobile application and online platform operated by Miutaxi Limited ("Miutaxi") for passengers to book taxi services and for taxi drivers to provide services.

1.2「乘客 App」指讓乘客預約、支付及管理的士行程的流動應用程式。"Passenger App" means the mobile application for passengers to book, pay for and manage taxi trips.

1.5「行程」指經平台預約、由司機夥伴提供的的士載客服務。"Trip" means a taxi carriage service booked via the Platform and provided by a Driver Partner.

1.6「咪錶車費」指行程期間的士咪錶所顯示、根據香港法例第374E章《道路交通（公共服務車輛）規例》所訂明的收費。"Metered Fare" means the fare displayed on the taxi meter during a Trip, charged in accordance with the Road Traffic (Public Service Vehicles) Regulations (Cap. 374E) of Hong Kong.

1.8「通行費」指任何適用的道路、橋樑、渡輪、隧道及機場收費及費用；對於咪錶行程，通行費指符合香港的士規例嘅相關收費。"Tolls" means any applicable road, bridge, ferry, tunnel and airport charges and fees; for metered trips, Tolls means those charges consistent with local Hong Kong taxi regulations.

1.9「服務地區」指平台允許乘客預約行程嘅地區，現時為香港特別行政區。"Service Area" means the areas where the Platform allows Trips to be booked, currently the Hong Kong Special Administrative Region.

2. 平台角色 Nature of the Platform

2.1的士租收係一個預約及資訊平台，透過乘客 App 同畀司機夥伴用嘅「司機夥伴 App」撮合乘客同獨立司機夥伴。的士租收唔係承運人，亦唔擁有或營運任何的士。Miutaxi is a booking and information platform that matches Passengers with independent Driver Partners through the Passenger App and the "Driver Partner App" (Clause 1.3). Miutaxi is NOT the carrier and does not own or operate any taxi.

2.2行程嘅運輸合約係乘客同司機夥伴（的士車主／司機）之間直接訂立，受香港的士法例規管。The contract of carriage for each Trip is made directly between the Passenger and the Driver Partner (taxi owner/driver) and is governed by Hong Kong taxi legislation.

3. 賬戶 Accounts

3.1 資格你必須年滿 18 歲，或由父母／監護人陪同下使用平台，先可以註冊賬戶。Eligibility: You must be at least 18 years old (or use the Platform under parental/guardian supervision) to register an Account.

3.2 賬戶你須以有效香港流動電話號碼註冊，並經一次性短訊驗證碼（OTP）核實身份。你同意(a)提供真實、準確、完整嘅資料，(b)妥善保管登入資料，(c)賬戶下嘅所有活動由你負責。Account: You must register with a valid Hong Kong mobile number and verify your identity via a one-time password (OTP). You agree to (a) provide true, accurate and complete information, (b) keep your login credentials secure, and (c) be responsible for all activity under your Account.

3.3 一人一賬戶未經的士租收書面同意，你唔可以開多過一個賬戶，亦唔可以轉讓賬戶。One Account per person: You may not create more than one Account or transfer your Account without Miutaxi's written consent.

4. 使用平台 Use of the Platform

4.1 預約行程你可以透過乘客 App 輸入上車點及目的地預約行程。上車點可以喺地圖上直接揀選或搜尋任何香港地點。Booking a Trip: You may book a Trip by entering your pickup point and destination in the Passenger App. The pickup point may be selected on the map or by searching any Hong Kong location.

4.2 廣播派單行程請求會廣播俾附近開工中嘅司機夥伴。司機自願接單；如果一定時間內冇司機接單，平台會擴大廣播半徑。平台不保證任何行程一定有司機接單。Broadcast Dispatch: Trip requests are broadcast to nearby Driver Partners on duty. Acceptance is voluntary; if no driver accepts within a certain time, the Platform expands the broadcast radius. The Platform does not guarantee that any Trip will be accepted.

4.3 禁止行為你承諾唔會：(a)利用平台作任何非法用途；(b)干擾平台運作或爬取數據；(c)利用假賬戶、機械人下單；(d)騷擾司機夥伴或其他用戶；(e)於備註欄填寫電話號碼或敏感個人資料，以避免受滋擾。Prohibited Conduct: You must not (a) use the Platform for any unlawful purpose; (b) interfere with the Platform or scrape data; (c) place orders via fake accounts or bots; (d) harass Driver Partners or other users; (e) enter phone numbers or sensitive personal data in the remarks field to avoid harassment.

5. 車費、貼士及付款 Fares, Tips and Payment

5.1 咪錶車費為準平台行程一律以的士咪錶收費。任何喺 App 內顯示嘅預估車費只供參考，最終車費以咪錶於行程結束時顯示嘅金額為準。Metered Fare Prevails: All Trips are charged on the taxi meter. Any estimated fare shown in the App is for reference only; the final fare is the amount shown on the meter at the end of the Trip.

5.2 通行費行程涉及嘅隧道費、橋樑費及其他通行費由乘客承擔，按實際收取。Tolls: Tunnel, bridge and other Tolls incurred during a Trip are borne by the Passenger at actual cost.

5.3 附加貼士乘客可自願於咪錶車費外附加貼士（「附加貼士」），例如喺繁忙時段提高接單機會。附加貼士全數給予司機，平台唔會抽佣。乘客可於司機接單前隨時調整或取消附加貼士；一經司機接單，附加貼士即鎖定。Additional Tip: Passengers may voluntarily add a tip on top of the Metered Fare ("Additional Tip"), e.g. during peak hours to improve acceptance odds. Additional Tips are paid ENTIRELY to the driver — the Platform takes no commission. You may adjust or cancel the Additional Tip any time before a driver accepts; upon acceptance it is locked.

5.4 付款方式行程可選擇現金或電子付款（視乎司機夥伴支援）。現金行程，你須於下車時支付咪錶車費＋附加貼士＋通行費。電子付款行程，授權金額會於行程確認後向你嘅支付工具收取。Payment Methods: Trips may be paid by cash or electronic payment (subject to Driver Partner support). For cash trips you must pay the Metered Fare + Additional Tip + Tolls on alighting. For e-payment trips the authorised amount is charged to your payment instrument after trip confirmation.

5.5 平台服務費的士租收就每程行程向司機夥伴收取平台服務費，詳情載於司機夥伴使用條款。的士租收唔會就行程向乘客收取訂閱費或隱藏費用。Platform Service Fee: Miutaxi charges Driver Partners a platform service fee per Trip as set out in the Driver Partner Terms. Miutaxi does not charge Passengers any subscription or hidden fees.

6. 取消 Cancellations

6.1司機接單前，你可以隨時免費取消行程。You may cancel a Trip free of charge at any time before a Driver Partner accepts it.

6.2司機接單後，如司機已前往上車點，你取消行程可能需支付合理嘅空駛費用（由司機收取）以補償司機時間。After acceptance, if the Driver Partner has already travelled towards your pickup point, cancellation may incur a reasonable dead-mileage fee (collected by the driver) to compensate the driver's time.

6.3司機接單後 5 分鐘仍未到達且無合理解釋，或司機單方面取消，你可以免費重新叫車，已鎖定嘅附加貼士會全數退回。If the driver fails to arrive within 5 minutes of acceptance without reasonable explanation, or cancels unilaterally, you may re-book free of charge and any locked Additional Tip is refunded in full.

7. 行為及安全 Conduct and Safety

7.1 乘客義務你同意：(a)保持禮貌對待司機夥伴；(b)唔好攜帶違禁品或危險物品；(c)繫好安全帶；(d)唔好要求司機超速或違反交通規則；(e)愛護車廂，弄污車廂可能需支付清潔費。Passenger Obligations: You agree to (a) treat Driver Partners courteously; (b) not carry prohibited or dangerous items; (c) wear seat belts; (d) not ask drivers to speed or breach traffic rules; (e) take care of the vehicle — soiling may incur a cleaning fee.

7.2 寵物及行李攜帶寵物或大型行李須喺預約時註明，並遵守司機夥伴嘅安排（例如放入籠或墊布）。Pets and Luggage: Pets or bulky luggage must be declared at booking and follow the Driver Partner's arrangements (e.g. carrier or protective mat).

7.3 評分行程結束後你可以為司機評分及留言。評分係雙向嘅：司機亦會評乘客。持續低分或濫用評分系統可導致賬戶受限。Ratings: You may rate and review drivers after each Trip. Ratings are two-way: drivers rate passengers too. Persistently low ratings or abuse of the rating system may lead to account restrictions.

8. 電子通訊 Electronic Communications

8.1你同意的士租收以短訊、電郵或 App 內通知向你發送行程資訊、服務變更及賬戶通知。You agree that Miutaxi may send you trip information, service changes and account notices by SMS, email or in-app notifications.

8.2 車內訊息平台提供乘客與司機之間嘅車內訊息功能（毋須交換電話號碼）。通訊內容會按私隱政策保存。嚴禁利用車內訊息騷擾、辱罵或招攬其他業務。In-Trip Chat: The Platform offers in-trip chat between Passenger and driver (no phone numbers exchanged). Chat content is retained per the Privacy Policy. Using in-trip chat to harass, abuse or solicit other business is strictly prohibited.

9. 個人資料 Personal Data

9.1的士租收會按《的士租收私隱政策》（構成本條款一部分）收集、使用及保存你嘅個人資料，包括電話號碼、行程記錄及位置數據。私隱政策：見 App 內「設定 → 私隱政策」或網站。Miutaxi collects, uses and stores your personal data (including phone number, trip records and location data) in accordance with the Miutaxi Privacy Policy, which forms part of these Terms. See "Settings → Privacy Policy" in the App or the website.

9.2你可以喺設定頁面刪除用戶賬戶；刪除後你的個人資料會按私隱政策處理（法律要求保留嘅除外）。You may delete your Account in the Settings page; after deletion your personal data is handled per the Privacy Policy (except where retention is required by law).

10. 知識產權 Intellectual Property

10.1平台嘅所有軟件、商標、設計及內容嘅知識產權由的士租收或其授權人擁有。未經書面許可，唔可以複製、修改或作商業用途。地圖數據及瓦片由 © OpenStreetMap 貢獻者提供（ODbL 授權）。All intellectual property in the Platform's software, trademarks, designs and content belongs to Miutaxi or its licensors. No copying, modification or commercial use without written permission. Map data and tiles © OpenStreetMap contributors (ODbL).

11. 免責及責任限制 Disclaimers and Limitation of Liability

11.1 服務按「現狀」提供平台按「現狀」及「可用狀態」提供。的士租收唔就接單速度、行程時間或咪錶車費金額作出保證。Service "As Is": The Platform is provided "as is" and "as available". Miutaxi makes no guarantee as to acceptance speed, trip duration or Metered Fare amounts.

11.2 責任限制在法律允許嘅最大範圍內，的士租收就本條款唔會對任何間接、衍生損失負責；的士租收嘅累計責任以涉及行程嘅咪錶車費金額為上限。行程期間嘅人身或財物損失，由承運人（司機夥伴）及其保險按香港法例承擔。Limitation: To the maximum extent permitted by law, Miutaxi is not liable for indirect or consequential losses, and Miutaxi's aggregate liability is capped at the Metered Fare of the Trip concerned. Personal injury or property loss during a Trip is borne by the carrier (Driver Partner) and their insurance under Hong Kong law.

11.3 賠償你因違反本條款或適用法律而引致第三方索償，你同意向的士租收作出賠償。Indemnity: You agree to indemnify Miutaxi against third-party claims arising from your breach of these Terms or applicable law.

12. 條款變更 Amendments

12.1的士租收可不時修訂本條款，修訂版會喺 App 內公佈並更新版本號。你喺修訂生效後繼續使用平台，即視為接受修訂。重大變更會提前 14 天通知。Miutaxi may amend these Terms from time to time; amendments are published in the App with an updated version number. Continued use after the effective date constitutes acceptance. Material changes will be notified 14 days in advance.

13. 終止 Termination

13.1你可以隨時喺設定頁刪除賬戶終止使用。的士租收可喺你違反本條款、濫用平台或法律要求下暫停或終止你嘅賬戶。You may terminate at any time by deleting your Account in Settings. Miutaxi may suspend or terminate your Account if you breach these Terms, abuse the Platform, or where required by law.

14. 一般條文 General

14.1 管轄法律本條款受香港特別行政區法律管轄，雙方不可撤銷地接受香港法院嘅非專屬司法管轄權。Governing Law: These Terms are governed by the laws of the Hong Kong SAR, and both parties submit to the non-exclusive jurisdiction of the Hong Kong courts.

14.2 可分割性如任何條文被裁定無效，其餘條文仍然有效。Severability: If any provision is held invalid, the remainder stays in force.

14.3 完整協議本條款連同私隱政策構成雙方就使用平台嘅完整協議。Entire Agreement: These Terms together with the Privacy Policy constitute the entire agreement regarding use of the Platform.
